Our Firm views that good policy influences fair competition both in the international and domestic markets. Therefore, we focus on working with Governments, International Organisations, Non-Governmental Organisations and Private Firms and Society Organisations to promote democratic and evidence-based law-making process and implement the policies in a fair and equitable manner.

How we work.

2023 RCEP Implementation

We assisted the Coordinating Ministry for Economic Affairs (CMEA) to implement the Regional Comprehensive Economic Partnership Agreement (RCEP) that was ratified by Indonesia on 30 August 2022. We worked together with an appointed Consultant to identify key regulatory gaps in Indonesia’s trade and investment and service sector regulations that need to be amended to conform with the RCEP commitments. The regulatory gap analysis contributes to the finalisation of the Presidential Regulation on RCEP Implementation Action Plan that is hoped to promote RCEP utilisation amongst the Indonesian exporters and foreign investors from the RCEP Parties.

2021 Negative List Revision

We assisted the CMEA in amending the Negative List of Investment through the issuance of Presidential Regulation No.10 and 49 Year 2021. We contributed to the adoption of a methodology that requires foreign investment restrictions and limitations to be based on the existing Laws and Government Regulations, not on the subordinate legislations or some unwritten policies. This methodology allowed for the opening of a substantial number of business sectors for 100% foreign investments. This reform is considered as the most significant reform in the Indonesian foreign investment framework since 1967.

2021 OECD Product Market Regulation Survey

We were engaged by the OECD to undertake Product Market Regulation (PMR) Survey in Indonesia. PMR Survey analyses regulations in the network, service, investment, State-Owned Enterprise, and Good Regulatory Practice implementation to measure how those regulations restrict competition in Indonesia. In undertaking the survey we liaised with various line Ministries, including the Ministry of Public Works, Ministry of Communications and Information, Ministry of Law and Human Rights, Ministry of Energy and Ministry of State-Owned Enterprise. The findings of this Survey was presented to the CMEA and the respective Line Ministries and published on the OECD website.
